Terms of Service

These Terms of Service ("Terms") govern your use of ASOrbit, operated by Simen Mathiesen Digital (ENK) ("we", "our", "us"). By creating an account or using the service, you agree to these Terms.

1. The Service

ASOrbit is an App Store Optimization (ASO) platform that helps app developers manage metadata, track keyword rankings, analyze competitors, and optimize their App Store presence. The service integrates with Apple's App Store Connect API and uses AI-powered analysis to provide recommendations.

ASOrbit is currently in beta (v0.1). Features may change, and the service may experience downtime or bugs. We provide the service on an "as is" and "as available" basis.

2. Accounts

  • You must provide a valid email address and create a password to use ASOrbit.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the service.
  • One person or entity per account. Account sharing is not permitted.

3. App Store Connect Credentials

  • To use ASOrbit's sync features, you provide your Apple App Store Connect API credentials.
  • Your credentials are encrypted at rest and only used to access App Store Connect on your behalf.
  • You are solely responsible for ensuring you have the right to provide these credentials and that their use complies with Apple's terms.
  • We are not affiliated with or endorsed by Apple Inc.
  • You can revoke access at any time by deleting your credentials from Settings or revoking the API key in App Store Connect.

4. Subscriptions and Billing

Plans

ASOrbit offers paid subscription plans (monthly, annual) and a lifetime purchase option. Prices are displayed on the subscribe page and may change with notice.

Billing

  • Payments are processed securely by Stripe. We do not store your payment card details.
  • Subscriptions renew automatically at the end of each billing period unless canceled.
  • You will be charged at the beginning of each billing period.

Cancellation

  • You can cancel your subscription at any time from the Billing page.
  • After cancellation, you retain access until the end of your current billing period.
  • Lifetime purchases are non-recurring and do not expire.

Refunds

We offer refunds on a case-by-case basis within 14 days of purchase. Contact us at [email protected] for refund requests. Lifetime purchases may be refunded within 14 days if the service does not meet your expectations.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of Apple's terms.
  • Attempt to access other users' accounts or data.
  • Reverse engineer, decompile, or attempt to extract the source code of the service.
  • Use automated tools to scrape or bulk-access the service beyond normal use.
  • Resell access to the service or share your account with others.
  • Submit credentials that you are not authorized to use.

6. AI-Generated Content

ASOrbit uses artificial intelligence to generate keyword suggestions, ASO assessments, and optimization recommendations. This content is:

  • Advisory only — AI suggestions are recommendations, not guarantees of App Store performance.
  • Your responsibility — you are responsible for reviewing and approving any changes before submitting them to App Store Connect.
  • Not guaranteed accurate — AI-generated analysis may contain errors or outdated information.

7. Intellectual Property

  • You retain ownership of all your app data, metadata, and content.
  • We retain ownership of the ASOrbit platform, its design, code, and branding.
  • You grant us a limited license to process your data solely for the purpose of providing the service.

8. Data and Privacy

Your use of ASOrbit is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Disclaimers

  • No guarantee of results. ASOrbit provides tools and suggestions to help with ASO. We do not guarantee improved App Store rankings, downloads, or revenue.
  • Third-party dependencies. The service depends on Apple's APIs and third-party services. We are not responsible for changes, outages, or limitations imposed by Apple, Stripe, or our AI provider.
  • Beta software. ASOrbit is in beta. We may introduce breaking changes, experience downtime, or discontinue features.

10. Limitation of Liability

To the maximum extent permitted by law, ASOrbit and Simen Mathiesen Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or App Store rankings, arising from your use of the service.

Our total liability for any claim arising from these Terms or use of the service shall not exceed the amount you paid us in the 12 months prior to the claim.

11. Termination

  • You may delete your account at any time by contacting us.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice in the app. Continued use of the service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Norway. Any disputes shall be resolved in the courts of Norway.
